What to do when accused of drunk driving

Being involved in a Colorado traffic accident is nerve racking enough. First one checks on the condition of everyone involved. Then, the damage done to the vehicles is surveyed. These steps usually take place while waiting for the police and other emergency response vehicles to arrive. Once law enforcement arrives, questions must be answered and decisions regarding fault and extenuating circumstance such as whether one of the drivers was drunk driving may be made.

If one of the drivers acts or appears to be under the influence of something, law enforcement will generally conduct sobriety tests to determine the individual's condition. While the officer may assume that his or her results are valid, this is not always the case. Additionally, the circumstances surrounded the testing must be considered. A driver can easily become distraught when faced with all of the questions, sirens and people milling about the accident scene.

Recently, the driver of an SUV was involved in an accident with a motorcycle. The motorcycle driver and his passenger were thrown from the bike and injured. It appears the SUV driver was uninjured. This accident occurred after dark on a Saturday evening. During the course of their investigation, the officers on the scene concluded that the SUV driver had been drinking and arrested him for drunk driving.

Whenever a Colorado resident is accused of drunk driving, he or she will want to present an appropriate defense. This is a serious charge that can have lasting effects if not properly handled. After analyzing the situation, the testing methods used and other criteria, an appropriate defense can be established.
