The Difference Between DUI and DWAI

The distinction between a DUI and a DWAI is based on your blood alcohol concentration (BAC) at the time of your blood alcohol test and subsequent arrest. If your BAC is between .05 and .079, you will be charged with driving while abilities impaired (DWAI). If you test at .08 or higher, you will be charged with DUI. While a DWAI is the less serious of the two charges, it will still result in 8 points on your driver's license and can result in fines. A DUI will add 12 points to your driving record, carries higher fines and can result in jail time.

If you test at .08 or higher and are charged with a DUI, your license will be suspended immediately. You then have seven days to request an Express Consent Hearing, where the court will determine whether the arrest was proper. We will ensure that the proper procedures were followed, that there was probable cause to pull you over, that you were properly advised of your rights before the police took any statements and that the field sobriety and breath tests were correctly administered.
