The Law on Assaults in Colorado

There are three categories of assault as defined by Colorado law:

  • First-degree assault: First-degree assault is the most serious type of assault crime. It is charged when a person, with the intent to cause serious bodily injury, to disfigure, dismember or through use of a deadly weapon, displays extreme indifference to human life or knowingly employs conduct that creates a grave risk to life and causes serious bodily injury. A conviction for first-degree assault carries with it significant penalties; working with an experienced lawyer is the best way to protect your rights.
  • Second-degree assault: Second-degree assault is considered less serious than first-degree assault, but it is still a felony. It is usually charged when the assault is committed in the heat of passion or during the course of another felony.
  • Third-degree assault: Third-degree assault is a misdemeanor. Is involves physical assault that results in bodily injury, when that physical assault is committed knowingly and recklessly, as part of criminal negligence or with a deadly weapon.
